This Risk Disclosure Statement is provided by PowrAI Digital Exchange sp. z o.o. ("PowrAI"), operator of Finquest Exchange, as required under its VASP licence obligations and applicable MiCA provisions. By using the Platform, you confirm acceptance of all risks described.

2. No investment advice

PowrAI does not provide investment, financial, legal, or tax advice. Nothing on the Platform constitutes a recommendation to buy, sell, or hold any digital asset. All trading decisions are your sole responsibility.

3. Material risk factors

3.1 Market risk — price volatility

Digital asset prices are subject to extreme volatility and may fall to zero in a very short period. Markets operate 24/7 with no circuit breakers and are influenced by speculation, regulatory news, and macroeconomic factors. Past performance is not indicative of future results.

3.2 Liquidity risk

Some assets may have limited liquidity. Large orders may move prices unfavourably. Bid-ask spreads may widen significantly during low-liquidity periods.

3.3 Technology and operational risk

• Blockchain protocols may contain bugs or be subject to forks;
• The Platform may experience outages, delays, or technical failures;
• Network congestion may delay transaction processing;
• Third-party systems (custody, payments, KYC) may experience independent failures.

3.4 Cybersecurity risk

• Despite PowrAI's security measures, the Platform may be subject to cyberattacks;
• Phishing, SIM-swapping, and social engineering attacks target exchange users;
• You are responsible for securing your own credentials and devices;
• PowrAI will never ask for your password or 2FA codes.

3.5 Regulatory and legal risk

• Digital asset regulation varies by jurisdiction and may change without notice;
• Assets are not protected by deposit guarantee schemes;
• Tax treatment of digital assets is complex — you are solely responsible for tax obligations;
• PowrAI's services may be affected by regulatory changes or enforcement actions.

3.6 Counterparty and custody risk

• No custody solution eliminates all risk;
• Service providers (Banxa, Sumsub, Fireblocks) may experience insolvency or operational failure;
• In PowrAI's insolvency, client asset treatment is subject to Polish insolvency law.

3.7 Fiat on/off ramp risk (Banxa)

• Fiat services are provided by Banxa independently;
• PowrAI is not responsible for Banxa delays, errors, or exchange rate movements;
• Fiat funds in transit may be subject to compliance holds or banking delays.

4. Not suitable for all users

You should only trade digital assets if: you fully understand the risks; you can afford to lose all invested capital; you have relevant experience and knowledge; and you are not trading with borrowed funds.
